Definitions

Guusto ("Guusto", "us", "we" or "our") connects its members ("Members" and "Users") to items offered by Merchants ("Merchants", "Venues") for a variety of services and products ("Products") through our website located at www.guusto.com. or via our Android and iOS applications. This Privacy Policy discloses the privacy practices for the website www.guusto.com., successor websites thereto and interactive features (such as applications and widgets) that provide an authorized link to this privacy policy (collectively and individually the "Website").

Subscribers: Subscribers are individuals or entities who use Guusto, for free or for charge, to send recognition, reward, and appreciation notes and gifts to their intended targets.

Users: Users are the recipients of the aforementioned notes of recognition, reward, and appreciation. Users create an account on the Guusto tool to track, redeem, and give thanks for gifts sent to them.

TYPES AND USES OF INFORMATION COLLECTED

Guusto collects two types of information from our Users and Subscribers: (i) Personally Identifiable Information; and (ii) Non-Personally Identifiable Information.

(i) Personally Identifiable Information

Personally Identifiable Information is information that identifies a specific person or persons. When you engage in certain activities on the Website, including, but not limited to, creating a Member or Merchant account, registering with us, ordering services or products from us, submitting content, submitting photos, posting content, sending feedback to us, requesting information about our services, or entering into an agreement, we may ask you to provide certain personal information about yourself, including things like your first and last names, and email address.

When you order Products, we will ask you to provide us with your payment method information (e.g., credit card number, expiration date and authentication codes) or related information. Depending on the activity, some of the information we ask you to provide is identified as mandatory and some are identified as voluntary. If you do not provide the mandatory information for a particular activity that requires it, you will not be able to engage in that activity.

To enable us to send your information to another person, via the Guusto servers, we may store your name and the name of any recipient. We may use that other person’s contact information (i.e. name, email address, mobile phone number) to allow them to access the information you requested we send. If you prefer that Guusto does not store personal information of a gift recipient (i.e. name, email address, phone number), there are alternative sending methods offered, other than through the Guusto servers.

If you are a customer or recipient and would no longer like to be contacted by the Subscriber that uses our service, please contact the client that you interact with directly.

We may also use Personally Identifiable Information to troubleshoot, resolve disputes, accomplish administrative tasks, contact you, enforce our agreements with you, inform you of important information, including our Website Terms of Use and this Privacy Policy, comply with applicable law and cooperate with law enforcement activities.

(ii) Non-Personally Identifiable Information

Non-Personally Identifiable Information is information that does not identify a specific user. As true with most web sites, we gather certain Non-Personally Identifiable Information and store it in log files. This type of information may include things like the Uniform Resource Locator (“URL") of the website you visited before coming to our Website, the URL of the website you visit after leaving our Website, the type of browser you are using and your Internet Protocol address. We and/or our authorized third party service providers and advertisers, may automatically collect this information when you visit our Website through the use of electronic tools like cookies and Web beacons or pixel tags.

We do not share any of your information with Merchants.

Sharing your Information with Authorized Third Party Service Providers

We may use third-party service providers to perform certain functions on our behalf, such as processing credit card payments, providing customer service, analyzing data and traffic flow, and handling certain communication functions. We may share your Personally Identifiable Information with such Service Providers solely as needed to fulfill such functions. We only work with third party service providers that adhere to strict privacy policies (e.g. SOC, PCI) that align with our own standards, however, the use of your Personally Identifiable Information by third party service providers is governed by their own set of privacy policies and is not subject to our control.

Sharing your Information Due to a Change in Control

As with any other business, Guusto could merge with or be acquired by another company, sell all or substantially all of its assets or a line of business, or undergo a similar event. Guusto has the right to assign or share the information it maintains, including Personally Identifiable Information, to one or more affiliates or to one or more successors, assigns, acquirers, or affiliates in connection with a restructuring, reorganization, merger, acquisition or other change of control of Guusto, as well as in the unlikely event of Guusto’s insolvency, bankruptcy or receivership. However, Personally Identifiable Information will remain subject to this Privacy Policy unless you agree to the contrary. Guusto will notify users of the Website of such an occurrence by posting a notice on the Website and emailing to the address you have provided us.

Sharing your Information for Guusto's Protection and for the Protection of Others

We may also disclose Personally Identifiable Information when we believe release is appropriate to comply with the law or a court order; enforce or apply this Privacy Policy, our Website Terms of Use. Additionally, we may also disclose Personally Identifiable Information or protect the rights, property or safety of the Website, its Users or others in situations that we believe involve potential threats to the physical safety of any person or property, if we believe that your information in any way relates to that threat.

Updating and Correcting Your Personally Identifiable Information

Opting out of Administrative Emails

As a condition of purchase of our Products and services, we will send you administrative emails. We will send you information regarding your account activity and purchases. You cannot opt-out of administrative emails. Administrative emails are emails related to a User's activity on the Website, and include emails regarding a particular User’s account, requests or inquiries, and purchases of Products and products and services.

Opting out of Promotional Emails

As a condition of purchase of our Products and services, we will also send you emails containing information regarding updates about our Products and promotional offers (“Promotional Emails"). Promotional Emails advertise our Products and services, including exclusive sales and other offers, and/or the products and services of our advertisers and affiliates. In contrast to administrative emails, you do have a choice with respect to receiving Promotional Emails. We will retain your information for as long as your account is active or as needed to provide you services. Guusto Gifts Inc. will retain personal data we process on behalf of our Subscribers for as long as needed to provide services to Users and retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Data that is no longer required for the purposes of performing the intended services or legal and financial record keeping, is purged in accordance with Guusto’s information disposal and sanitization procedures.

Tracking Technologies

Cookies

To facilitate and customize your experience with the Website, we may store cookies on your computer. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes which contains information about that user. We use cookies to save you time while using the Website, remind us who you are and track and target your interests in order to provide a customized experience. Other websites that may be accessible through this Website have their own privacy policies and data collection, use and disclosure practices. Disclaimer

While we employ commercially reasonable security measures to protect data and seek to partner with companies that do the same, we cannot guarantee the security of any information transmitted to or from the Website, and are not responsible for the actions of any third parties that may receive any such information.

In cases where a Subscriber enrolls users, Guusto Gifts Inc. has no direct relationship with those individuals whose personal data it processes. An individual who seeks access, who seeks to correct, amend, delete inaccurate data or withdraw consent to further contact should direct his/her query to Guusto Gifts Inc.‘s Client (the data controller, aka Subscriber). If a User requests Guusto Gifts Inc. to remove the data, we will respond to their request within 30 days.

As a User, upon request, Guusto Gifts Inc. will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. If your personally identifiable information changes, or if you no longer desire our service, you may request access to all your personally identifiable information to correct, update, amend, delete/remove or deactivate it by making the change by logging into your account, by emailing us at [email protected], or by contacting us by postal mail at the contact information listed below. We will respond to your request within 30 days.

Changes to our Privacy Policy

Guusto keeps its Privacy Policy under regular review and may modify or revise this Privacy Policy at any time by posting the amended terms on this Website. The revised Privacy Policy is effective immediately when posted on the Website. It is the responsibility of each User, Merchant of third party user to review the Website and the Privacy Policy periodically to learn of any revisions to this Privacy Policy. Your continued use of the Website after the effectiveness of such revisions constitute your acknowledgment and acceptance of the terms of the revised Privacy Policy.
